Article 1 – Purpose

These terms govern the event services provided by KIDAYS to business customers (companies, public bodies, associations, works councils, brands, and so on).

Article 2 – Quote and order

Every service is quoted for. The order is deemed firm and final once the quote has been approved, these terms accepted, and the deposit actually received by bank transfer.

Article 3 – Price and payment terms

Payments are made exclusively by bank transfer.

3.1 Deposit. A deposit is required when ordering. It constitutes a firm commitment and is non-refundable if the Customer cancels.

3.2 Balance. The balance must be paid by bank transfer no later than 7 days before the date of the event, unless the quote states otherwise. If the balance is not received within that period, KIDAYS reserves the right to suspend or cancel the service, which is then treated as cancelled by the Customer.

Articles 4 and 5 – Travel and site visits

Article 4 – Travel costs. Travel costs are included in the price stated in the quote. No additional travel charge may be claimed from the Customer, unless a specific request by the Customer gives rise to a new quote accepted by both parties.

Article 5 – Site visit. A site visit may be arranged at the Customer's request. The arrangements and any charges are set out in the quote.

Articles 6 and 7 – Cancellation

Article 6 – Cancellation by the Customer. If the Customer cancels, the deposit is retained by KIDAYS. If the balance has already been paid, the sums paid are also retained by KIDAYS, save by exceptional commercial agreement.

Article 7 – Cancellation by KIDAYS. If it becomes entirely impossible to deliver the service, all sums paid are refunded in full. No other compensation may be claimed, save in the event of gross negligence or where mandatory legal provisions state otherwise.

Article 8 – Late arrival

30 to 60 minutes late: 30% compensation. 60 to 90 minutes late: 50% compensation. More than 90 minutes late: 100% refund.

Article 9 – Team quality, liability, force majeure, insurance, data, governing law

The hosts working for KIDAYS are independent contractors. KIDAYS operates selection and incentive processes (competitive pay and bonuses) to secure teams that are qualified, motivated and committed on the day. KIDAYS is bound by an obligation of means.

No liability arises in the event of force majeure within the meaning of article 1218 of the French Civil Code. KIDAYS holds professional public liability insurance. Data is processed in accordance with the GDPR.

These terms are governed by French law. Disputes will be brought before the competent courts in the jurisdiction of KIDAYS' registered office.
